For example, JC Penny offers men's pant sized for people 5'8" - 5'11 1/2" (Regular), 6' - 6' 3 1/2" (Tall), and 6' 4" - 6' 7" (Extra Tall). The average height of an American male is 5' 9.2 " (source National Center for Health Statistics (2004).
I think it is reasonable to assume that height is normally distributed within a population. That would mean that there are as many people 1" shorter than the mean as there are people 1" taller than the mean. This would be expected for each increment in height in both directions from the mean.
The JC Penny practice of offer pant size from 5’8” to 6’7” range is clearly discriminatory toward shorter people since there are sizes offered up to 9.8” above the mean while offering only 1.2” below the range.
By offering sizes in the manner JC Penny sells jeans, they are discriminating against a large section of the population (e.g. all males less than 5'8" tall). This is irrational on their part since they are losing business. I’m not suggesting the JC Penny is alone with this practice; it seems all jeans retailers follow these same basic guidelines.
One definition of discrimination is irrational prejudice.
It seems to me that this size distribution is discriminatory against shorter people since even the regular size range is skewed toward taller people.
It is a significant expense to have clothing altered or specially made.

I was asked the other day (and have wondered myself) why so many short women tend to marry tall men. I can cite at least ten instances (in my own personal experience of friends and coworkers) of women between the heights of 4 feet, 11 inches and 5 feet, 3 inches who have married men over 6 feet tall and the woman who was 5 feet, 3 inches (the tallest in the group) married a man who was 6 feet, 9 inches tall!
Has anyone else noticed this? (On the personal side, I'm five feet, one inch and married a man who is six feet, two inches tall.)
